Course Agenda

Session 1:

Defensive Advocacy
presented by Frank Alfano, LL.B., LL.M.

Learn about, among other things:
Part One: Understanding Hand-Held Offences

  • The difference between distracted driving and hand-held device;
  • The identification of the device allegedly held;
  • The evidentiary requirements involved; and
  • The strategy for fighting the cases.

Part Two: Understanding Jordan Principles

  • The Jordan basics;
  • The pre-pandemic state of the law;
  • The post-pandemic state of the law;
  • The expected prosecution arguments - including the same factum that EVERY prosecutor uses; and
  • The big difference between Part I and III of the POA as it relates to Jordan applications.

Part Three: Understanding How to Use Disclosure

  • The reasons why disclosure is so important;
  • The uniqueness of disclosure concerns;
  • The disclosure you are entitled to;
  • The use of disclosure issues when making an 11(b) argument; and
  • The use of disclosure to corner the case of the prosecution.

Session 2:

Fighting Handheld Charges

  • The cross-examination strategies to help establish a reasonable doubt that the police officer was able to identify the object as a prohibited device;
  • The exemptions applicable to the holding of a cellphone or other prohibited device;
  • The live demonstration within a mock trial of how to defend against section 78.1, Highway Traffic Act, charges; and
  • The much more information that every legal practitioner should know.

The presentation also provided a mock trial complete with reading of the charges, swearing in of witnesses - both a police officer as well as the accused taking the stand.  Examinations of the witnesses to place with volunteer Daphannie Tremblay followed by Frank Alfano.
